FACILITY FAILED TO PROTECT EACH RESIDENT FROM ALL TYPES OF ABUSE SUCH AS PHYSICAL, MENTAL, SEXUAL ABUSE, PHYSICAL PUNISHMENT, AND NEGLECT BY ANYBODY.

State Findings:

Based on record review and interviews, it was determined the facility failed to ensure one (#1) of one sampled resident was free from abuse. The resident reported a CNA touched her inappropriately in her vaginal area. The facility identified 75 residents who resided in the facility.

Findings: A policy and procedure titled, Resident Abuse, Neglect and Misappropriation of Property, dated (MONTH) (YEAR), documented:

Policy

The resident has the right to be free from verbal, sexual, physical, and mental abuse . The facility will not tolerate mistreatment, neglect or abuse of residents. Verbal, mental, sexual, or physical abuse .will not be tolerated .

A police report, dated 11/11/19, documented abuse by a caregiver occurred on 11/02/19. The officer reported he was dispatched to the facility on [DATE] at 3:35 p.m. The resident reported to the officer, while providing incontinent care with a wash cloth, CNA #1 inserted two fingers into her vagina and moved them in a circular motion. The resident told the CNA it hurt and she informed the resident she had to get her clean. When the resident stated again it was hurting, CNA #1 stated you were married for over [AGE] years, you should be use to it.

The documentation of the facility’s investigation was reviewed. An Incident Report Investigation documented, Interviewed staff (CNA #4), (CNA #1) (LPN #3) on 11/7. Also interviewed (initials deleted) CN[NAME] Residents interviewed 11/7 (#2), (#3), (#4), (#5), (#6) . The report documented residents #7, #8, #9, #10, #11 and #12 were interviewed on 11/09/19.

An undated sheet included with the report documented: (CNA #4)- Reported 0630 (6:30 a.m.) on Sunday Rough with care gloved hand w/wipe inserted to vag to clean feces out named (CNA #1) specifically felt like using her fingers as ‘male part’ & was offended (CNA #1)- ‘hasn’t worked w/ her in months’

There was no documentation of interviews conducted with the resident, the resident’s family member or the three staff members who the facility reported they interviewed in the incident report. There was no documentation of the focused assessments conducted on the four identified residents. The interviews with the five residents who did not reside on the same hall as resident #1 documented, safe and three of those five residents did not require assistance with incontinent care.
