FACILITY FAILED TO PROTECT EACH RESIDENT FROM ALL TYPES OF ABUSE SUCH AS PHYSICAL, MENTAL, SEXUAL ABUSE, PHYSICAL PUNISHMENT, AND NEGLECT BY ANYBODY.

State Findings:

Based on interviews, observations and record reviews the facility failed to ensure residents were free from neglect for 6 of 6 residents (#2, #3, #4, #5, #6 and #7) whose care was reviewed for neglect, in that:

The facility’s structure to prevent abuse were not implemented when:

1. The facility failed to put interventions in place to manage Resident #1’s aggressive behaviors to protect the resident and other residents from incidents of abuse.

2. The failure of not having interventions in place for Resident #1’s aggressive behaviors led to an incident where resident #1 seriously injured Resident #3, resulting in Resident # 3 not wanting to come out of his room to avoid Resident #1.

3. The facility failed to protect Residents #2, #4, #5, #6 and #7 from abuse after they revealed they were afraid of Resident #1’s aggressive behaviors and did not feel safe and free from abuse in the facility.

These failures resulted in identification of an Immediate Jeopardy (IJ) on 02/19/2019. While the IJ was removed on 02/22/2019, the facility remained out of compliance at a level of actual harm with a scope identified as a pattern until interventions were put in place to protect residents from Resident #1’s repeated incidents of aggressive behavior and staff were trained on behavior strategies (dealing with residents with agitation and those with inappropriate behavior/suspicious paranoia and agitation) and abuse and neglect. This deficient practice could affect the residents at the facility and place them at risk for physical and/or psychosocial harm.

During an interview on 02/20/19 at 4:55 PM with Psychiatric NP, he revealed that he believed the facility does not meet Resident #1’s needs due to [MEDICAL CONDITION] violent behaviors. He further revealed Resident #1 residing in the nursing facility was unsafe and inappropriate. NP stated he recently adjusted the dosages on Resident #1’s psychiatric medications about two weeks ago and Resident #1 needs a more suiting long-term care living arrangement.

During an interview on 02/21/19 at 8:22 AM the Administrator confirmed there was no documentation of any interventions for Resident#1’s behavior. The Administrator further confirmed there was no behavior monitoring.
