State Findings:

Based on observation, resident and staff interviews, review of medical records, review of a personnel record, review of a facility Self-Reported Incident (SRI), and review of the facility’s abuse policy and procedure, the facility failed to ensure residents were free from physical abuse by a staff member. This resulted in Immediate Jeopardy for one resident (#66) when she was observed by three staff witnesses (Receptionist #05, Licensed Practical Nurses (LPN) #35 and #48) being dragged across the floor of her room and thrown into bed by State tested Nurse Aide (STNA) #69 after the resident had defecated on the floor. Additionally, a second resident (#2) was witnessed by a fourth staff member (STNA #72) to have his hand slapped multiple times by the same STNA (#69) while attempting to get the resident to move his hand during a transfer utilizing a mechanical lift. Consequently, all four staff witnesses failed to immediately report the observed incidents of resident abuse thus allowing STNA #69 to continue providing care for his assigned residents. This affected two of two residents (#66 and #02) reviewed for abuse and placed 12 additional residents (#03, #10, #14, #17, #20, #21, #23, #36, #41, #51, #52, #91) at risk for the likelihood of serious harm or injury who were assigned STNA #69 as their care giver.
