Based on review of a facility self-reported incident (SRI), medical record review, staff interview, review of a police report, review of the Phlebotomist Daily Mileage Sheet and review of the facility abuse policy, the facility failed to protect Resident #91 from sexual abuse. This resulted in Immediate Jeopardy for one resident (#91) who was sexually assaulted by Laboratory Technician (LT) #1. CONTINUING: On 05/08/13 when Resident #91 was sexually assaulted by LT#1 during a visit to obtain blood for laboratory (lab) sampling. On 05/08/13, Resident #91 had orders for several lab values to be obtained. LT #1 drew the blood work. When he was finished drawing Resident #91’s blood, LT #1 closed the door and drew the curtains around Resident #91’s bed. LT #1 then lifted Resident #91’s shirt and placed his penis between her breasts. LT#1 placed his hands on Resident #91’s breast and ejaculated. LT #1 also asked the resident to perform oral sexual acts.
CONTINUING: Resident #91 reported this incident lasted five to ten minutes and, after the incident, LT #1 put his index finger up to his lips as though he was telling her not to say anything and then said something along the lines of her being his favorite patient. The report revealed Resident #91’s history of a prior rape in 1978 and abusive relationship, and that Resident #91 stated she in no way consented to any sexual contact with LT #1. Upon contacting LT #1’s regional manager, it was discovered that since his employment began in March 2013 he had one complaint lodged in regards to him touching a female patient. The report also revealed, during an interview with the Administrator, it was discovered that, although there was a sign-in book at the facility, not everyone signed in, and LT #1 had not signed in the day the sexual abuse occurred. Review of a copy of the Phlebotomist Daily Mileage Sheet dated 05/08/13 revealed LT #1 was in the facility
between 8:25 A.M. and 10:35 A.M.
